The petitioner seeks bail in Kutumba P.S. case No. 71 of 2014 under Section 395 of the Indian Penal Code. It is submitted that petitioner is not named in the FIR. The petitioner was arrested in Kutumba P.S. case No. 31 of 2015 and he is said to have confessed his guilt. It is submitted that petitioner did not make any voluntary statement rather police forcibly took the signature of petitioner on a plain paper. No incriminating article has been recovered from the possession of the petitioner. The petitioner is in jail since 01.04.2016 but he has not yet been put on T. I. parade. The petitioner has remained in jail for more than 13 months.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.20469 of 2017 (2) dt.03-05-2017 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Kutumba P.S.
