1. Heard learned counsel for the petitioner and learned APP for the State, Mr. Chandra Bhushan Prasad.

The learned counsel for the petitioner submits that the victim has returned and her statement was recorded under Section 164 of the Cr.P.C., wherein she has not alleged anything against this petitioner, rather has stated that she got a call from an unknown number and she started talking and the caller later disclosed his name as Abhishek (petitioner) and later they fell in love and the petitioner called her to Rajgir where she went by hiring a Toto and from there they came to Bihta and then the petitioner asked one lady namely Puja Kumari to drop her to her home, but the lady confined her at Dhanbad railway station, but

Patna High Court CR. MISC. No.67674 of 2024(3) dt.29-01-2025 2/2 she somehow managed to escape from her clutches and returned back to Nalanda after 2-3 days. It is further submitted that the victim has not alleged that petitioner in any manner acted inappropriately with her.

The learned APP for the State, Mr. Chandra Bhushan Prasad, opposes the anticipatory bail application of the petitioner on the ground that no doubt the victim has not alleged anything against the petitioner but then she is aged about 14 years as disclosed in her statement recorded under Section 164 of the Cr.P.C.

4. The learned counsel for the petitioner, at this stage, seeks permission to withdraw the anticipatory bail application.

5. Permission is accorded.

6. Accordingly, the present anticipatory bail application is dismissed as withdrawn.
