JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 The petitioner being husband of the victim has renewed his prayer for bail in a case registered under Sections 302, 201 of the I.P.C.
The accusation is killing the wife after 12 to 13 years of marriage.
It is submitted by learned counsel for the petitioner that the victim died due to illness and the children of the victim has not supported the accusation. It is further submitted that at the time of argument of regular bail it was wrongly submitted that charge-sheet was submitted under Section 302 of the I.P.C though charge-sheet has been submitted under Section 306 of the I.P.C and cognizance has also been taken under Section 306 of the I.P.C. The statements to that effect have been made in para 8 and 9 of the petition. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.43614 of 2014 (2) dt.18-02-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Madhubani in connection with Sessions Trial No. 122 of 2013, arising out of Bisfi(Patauna) P.S. Case No. 246 of 2012.
