JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2017 The petitioner seeks regular bail in connection with G.R.P./D.B.G./S.M.I. P.S. Case No. 06/2017, registered for offences punishable under Section 370/34 of the Indian Penal Code and Section 79 of J.J. Act, 2015.

Allegation against the petitioner and other accused persons is that they were engaged in human trafficking and team of S.S.B and railway police raided the Sitamarhi Railway Station and caught the petitioner and other three accused persons and from their clutches got six children released.

It has been submitted on behalf of the petitioner that he has falsely been implicated and in fact he is taking the children to Bombay for their studies. It has further been submitted that other co-accused person having similar allegation has already been

Patna High Court Cr.Misc. No.20741 of 2017 (3) dt.28-06-2017 2/3 granted the privilege of regular bail vide order dated 24.05.2017 passed in Criminal Miscellaneous No. 23419 of 2017 and petitioner has been in judicial custody since 20.01.2017. Heard learned A.P.P. also.

Having heard both sides, no doubt allegation against the petitioner is serious, however, considering the fact that other accused persons having similar allegation has already been granted bail by this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned ACJM, Rail, Samastipur, in connection with G.R.P./D.B.G./S.M.I. P.S. Case No. 06/2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event

Patna High Court Cr.Misc. No.20741 of 2017 (3) dt.28-06-2017 3/3 of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.

It is also made clear that if petitioner's active participation is found in any similar offences, in future, his bail bonds shall be cancelled.
