JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-09-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of a writ in the nature of mandamus or any other appropriate writ commanding the petitioner has prayed for direction of payment of family pension to the second wife from respondent. According to Nomination of Name entered in pension Book as per spouse in the P.P.O. (hereinafter referred

Patna High Court CWJC No.16893 of 2015(2) dt.01-09-2023 2/2 to as Act of family pension) (ii) For that wife Smt. Raj keshi Devi she has died in harness on 18th of April, 2001.

(iii). For that she is now to more in the worth child and not any dependent as her and no other legal heir. So in which reason or condition the petitioner has action to payment of pension in favour of second wife."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
