JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Surajgarha P.S. Case No. 60 of 2015 registered under Sections 147, 148, 149, 342, 324, 326, 307, 504 and 302 of the Indian Penal Code.

The accusation is that in the evening of 05.04.2015, Haggan Singh, brother-in-law of the informant, came at the house for taking dinner. At that time, 11 persons named in the F.I.R. including the petitioners came armed with rifle and pistol and started firing. On hearing the sound of firing, Haggan Singh fled away from there then he was chased at some distance near the filed of Samnarayan Singh and Phucha Singh. On the order of

Patna High Court Cr.Misc. No.44549 of 2016 (2) dt.27-10-2016 2/2 Hado Singh, Amaresh Singh shot fire at Dadan Singh. Learned counsel appearing on behalf of the petitioners submits that petitioner has falsely been implicated in this case due to enmity. Moreover, there is specific allegation against the Amresh Singh to shot fire at the order of Hado Singh. Further submission is that similarly situated co-accused Hado Singh has already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 28398 of 2015 on 09.10.2015. It is also submitted that petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Lakhisarai in connection with Surajgarha P.S. Case No. 60 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
