Petitioner seeks bail in Jagdishpur P.S. Case No. 73 of 2017 for the offence punishable under Section 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016(Amended).

It is alleged that three bottles of Mc. Dowel No. 1 reserve whisky of 7.50 ml. sealed pack were recovered from the possession of the petitioner. The petitioner is in custody since 27.03.2017. The petitioner has got no criminal antecedent as

Patna High Court Cr.Misc. No.20844 of 2017 (2) dt.08-05-2017 2/2 mentioned in paragraph no. 3 of this petition. Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jagdishpur P.S. Case No. 73 of 2017 to the satisfaction of learned IVth Additional Sessions Judge, Bhagalpur, subject to the condition that both the bailors should be close relatives of the petitioner.
