2. Permission is accorded.

3 . This bail petition of petitioner No. 2 is dismissed as withdrawn .

4. Heard learned counsel for the petitioner No. 1 and the State .

5 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 126 ( 2 ), 118 (1) , 118 ( 2 ), 109, 303 ( 2 ) and 3(5) of BNS.

6. As per the prosecution case , informant namely

Patna High Court CR. MISC. No.59281 of 2025(2) dt.01-09-2025 2/3 Garima Singh alleged that on 31.05.2025 , when husband of informant and one Manoj Kumar were going to their land, in the meantime , they saw that main way of village was being cut by means of JCB and when husband of informant opposed the same then accused persons assaulted him with iron rod, axe due to which he sustained injury and other accused persons snatched his gold chain .

7. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. Specific accusation of assault is against other co-accused Indra Sen and Ashutosh Kumar and so far as, this petitioner is concerned, there is general and omnibus allegation of assault against him. There is admitted land dispute between the parties. Petitioner has got one criminal antecedent in which he is on bail. 8 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts, and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner No. 1 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Judicial Magistrate First
