2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 137(2) of the B.N.S, 2023.

3. As per the prosecution case, petitioner is alleged to have kidnapped the son of informant (victim) aged about 14 years.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Both parties are agnates. Petitioner claims clean antecedent.

5. Learned APP however, vehemently opposes the prayer for bail and submits that the victim in his statement

Patna High Court CR. MISC. No.59651 of 2025(3) dt.25-11-2025 2/2 recorded under Section 183 BNSS has clearly stated that this petitioner kidnapped him. The trial Court has assessed the age of victim boy as 14 years.

6. Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Agiaon (Garhani) P.S. Case No. 75 of 2025 pending in the court of Learned Additional Chief Judicial Magistrate, VIII, Bhojpur at Ara. Accordingly, the same is rejected.
