The petitioners apprehend their arrest in a case registered for the offence under Sections 302, 201/34 of the Indian Penal Code.
As per the prosecution case, sister of the informant was married with co-accused Chandan Rai four year ago and after the marriage, the accused persons used to quarrel with her. On 21.04.2021, the informant came to know that accused persons killed his sister and burnt the dead body. On this information, the informant went there and saw half-burnt body of his sister in a pond and part of her dead-body was recovered from the pond.
Patna High Court CR. MISC. No.71211 of 2021(2) dt.20-07-2022 2/2 Petitioner no. 1 is father-in-law and petitioner no. 2 is mother-in-law of the deceased. There is general and omnibus allegation and no specific allegation of overt act has been alleged against these petitioners. As a matter of fact, the deceased was ill-tempered lady and she committed suicide on a railway track in the night and thereafter, family members have cremated the dead body of the deceased. It is further submitted that after intervention of will-wishers, both parties have compromised the case and to this effect, a joint compromise petition has been filed, which is at Annexure -2. However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against these petitioners and dead-body was found near the pond and was disposed of without giving any information to the informant.
Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioners is rejected. (Prabhat Kumar Singh, J) anay/- U T
