Petitioner is in custody since 18.01.2017 in connection with Sourbazar P.S. Case No. 353 of 2012 registered under Sections 341, 323, 325, 379, 307, 341 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner has not been named in the F.I.R. and on the basis of restatement of informant and re-statement of father of main accused, Santu Kumar, name of this petitioner has been surfaced in this case. Except that there is nothing against the petitioner. Further the injury sustained by the informant also appears to be simple in nature. Moreover, a compromise has arrived at between the parties. The petitioner is rotting in custody for the last three and half months. Considering the facts and circumstances of the case, let
