The petitioner apprehends his arrest in a case registered for the offence under Section 366(A) & other minor sections of the Indian Penal Code.

It is submitted on behalf of petitioner that the victim, in her statement recorded under Section 164 Cr.P.C., has specifically stated that out of her own will she went with this petitioner and solemnized marriage with petitioner. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioner, in the event of his

No.71180 of 2021(3) dt.31-08-2022 2/2 arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 148 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
