The petitioner seeks bail in Bariyarpur P.S. Case No. 106 of 2016 registered for the offences punishable under Sections 384, 387 and 34 of the Indian Penal Code.

The informant named Dhiraj Chaudhary and alleged that Dhiraj Chaudhary demanded his mobile number and after sometime a call came from mobile number 7372003197 and the caller disclosed his name as Santosh Chaudhary @ Tarjan. The caller demanded extortion of Rs. 50,000/-.

Learned counsel for the petitioner submits that the aforesaid mobile number does not belong to the petitioner. The name of the petitioner figured in the case on mere suspicion. No tangible material has been collected during course of investigation.

Patna High Court Cr.Misc. No.21045 of 2017 (3) dt.20-06-2017 2/2 Prayer for bail of the petitioner was rejected only because the petitioner has got criminal antecedent. The petitioner is in jail since 20.12.2016.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for six months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Bariyarpur P.S. Case No. 106 of 2016.
