The petitioner seeks pre- arrest bail in connection with Sadar P.S.Case No.545 of 2013 registered under Sections 467, 468, 420 and 409 of the Indian Penal Code.
It is contended that the petitioner is neither named in the FIR nor any material could be collected against him during investigation. In the FIR one Nityanand Das, Managing Director of Purnea District Central Co-operative Bank Limited and Chandeshwar Prasad Singh, Branch Manager of Gulab Bagh Branch of the said bank were made named accused. Co-accused Nityanand Das has been granted bail by a Bench of this Court vide order dated 25.6.2014 passed in Cr. Misc. No.18152 of 2014 and Chandeshwar Prasad Singh has been granted bail by a Bench of
Patna High Court Cr.Misc. No.44556 of 2015 (2) dt.14-10-2015 2/2 this Court vide order dated 15.5.2015 passed in Cr. Misc. No.36584 of 2014. It is further contended that in course of investigation name of the petitioner and his mother surfaced. They are none-else but son and wife respectively of co-accused Chandeshwar Prasad Singh, who has already been granted anticipatory bail. Even Nutan Devi, the mother of the petitioner has also been granted anticipatory bail by order dated 30.9.2015 passed in Cr. Misc. No.39732 of 2015. Learned counsel for the State does not dispute these facts.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No.545 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
