This is a petition for grant of regular bail for offence under Sections 413 and 34 of the Indian Penal Code and 8 and 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Thirty eight kilogram ganja was recovered, when the petitioner was carrying the same through Sanghmitra Express train. The recovery was made on the basis of information from the spies and after formation of different team of police, as initial information was that the ganja was being brought by the petitioner on the bus and from Patna it is to be carried for Banglore through train.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 07.10.2016. the petitioner has stated on oath that he has got no criminal antecedent and he has been apprehended on suspicion from general class though ganja was recovered from the sleeper class.

Considering the nature seriousness of the allegation

Patna High Court Cr.Misc. No.22163 of 2017 (5) dt.14-07-2017 2/2 against the petitioner, I am not inclined to enlarge the petitioner on bail.

The prayer for bail is refused.

The learned trial Court is directed to expedite the trial.
