JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Karja P.S. Case No. 212 of 2021 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code 1860 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The Police on the basis of secret information that the petitioner concealed illicit liquor in his house situated in the forest, proceeded towads his house. On search, a total quantity of 25 litres of country made liquor has been recovered from the forest situated behind the house of the petitioner. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique

He next submits that illicit liquor has not been recovered either from conscious possession of the petitioner or the premises belonging to him, the petitioner is in custody since 24.10.2021 having clean antecedent and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that there is no recovery of illicit liquor from possession of the petitioner, the petitioner is in custody since 24.10.2021 having clean antecedent and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Karja P.S.
