The petitioner no. 1 being husband of the sister of the complainant and petitioner nos. 2 and 3 being parents of petitioner no. 1 are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 406 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

It is alleged that the complainant fixed the marriage

Patna High Court Cr.Misc. No.43371 of 2014 (3) dt.04-05-2015 2/3 of his sister with petitioner no. 1 when Rupees Two Lacs Ninety Thousand was given by the complainant but subsequently the accused refused to marry.

On the joint prayer of the parties, vide order dated 18.2.2015 the matter was referred to the Mediation Centre of State Legal Services Authority.

A supplementary affidavit has been filed bringing on record the report of Mediation Centre which reflects that the issue has been resolved by the parties and the petitioners have made payment of Rs.62000/- to the complainant and the complainant agree to withdraw the Complaint Case No. 1219 of 2013.

Considering the issue being reconciled between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya in connection with Complaint Case No. 1219 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
