This is a case registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code. Subsequently, Section 302 of the Indian Penal Code was added.

Learned counsel for the petitioner submits that the date of occurrence is said to be on 20.08.2016 whereas F.I.R. has been lodged on 28.08.2016. In the meantime, the victim was admitted at two places one in P.M.C.H. on 20.08.2016 and another in Sri Vinayak Hospital on 25.08.2016. Both these places, the documents (Annexure 2 and Annexure 3) show that the admission of the victim has been made showing it to be road accident.

Other relevant submission for the purpose of bail is that the Driver and the Khalasi of the Jai Ram Bus have not been examined, which is a public Transport Bus even the injury report of the Pappu Kumar in paragraph-80 of the case diary shows that the injury to be caused by R.T. Accident. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kinjar P.S.
