JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 1045 of 2011 arising out of S.K. Puri P.S. Case No. 74 of 2011 instituted for the offence under Section 365 of the Indian Penal Code. Subsequently, Sections 364(A) and 302 of the Indian Penal Code was added.

This petition has been filed for grant of provisional bail to the petitioner on the ground that marriage of his sister is going to take place on 12.5.2017.

The counsel for the opposite party No. 2 has appeared and stated that the case is at final stage of argument and judgment is likely to be pronounced within a month.

From the impugned order it appears that earlier the

Patna High Court Cr.Misc. No.21210 of 2017 (2) dt.09-05-2017 2/2 case was fixed for judgment after concluding the argument. However, judgment could not be passed and, thereafter, the case has again come up for argument before the 1st Additional Sessions Judge, Patna, which is pending at final stage. Therefore, this Court is not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner stands rejected. The court below is directed to conclude the argument and pass final judgment in this case within a period of two months positively.
