JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 06-07-2017 Heard learned counsel for the petitioner. Despite repeated calls, nobody appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with Kadamkuan P.S. Case No. 39 of 2014 registered for the offences punishable under Section 304-B/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. In the FIR, the informant has alleged that she gathered information about admission of her daughter in Patna Medical College and Hospital and also gathered information that she has been poisoned by her in-laws.

It is stated by the learned counsel for the petitioner that the F.I.R. was instituted in haste. However, later on, after

No.21208 of 2017 (2) dt.06-07-2017 2 / 2 coming to know the real fact, the informant herself filed an application in the court of the learned Chief Judicial Magistrate stating therein that there was no fault of the petitioner in the alleged occurrence and that her daughter had in fact committed suicide. Learned counsel for the petitioner further submitted that the co-accused Janki Devi, Monu Rajak @ Monu Kumar and Dipu Rajak @ Dipak Kumar @ Deepu Rajak have already been granted pre-arrest bail by this Court vide order dated 13.03.2015 passed in Cr. Misc. No.39895 of 2014.

Considering the nature of allegation and the submission made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna in connection with Kadamkuan P.S. Case No. 39 of 2014 (G.R. No.449 of 2014) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
