This is a petition for grant of regular bail for offences under Sections 341, 307, 379 and 504/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code added and 27 of the Arms Act.
Unknown motorcycle borne criminals shot at the informant as well as at the brother of the informant, as a result whereof both sustained injuries and the brother of the informant died during the course of treatment. Petitioner is co-villager of the informant. He was arrested on suspicion and his statement was recorded before the police wherein the petitioner confessed his guilt.
Submission of the petitioner is that only material
Patna High Court Cr.Misc. No.21474 of 2017 (2) dt.08-05-2017 2/2 against the petitioner is confession before the police, which is no evidence.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Tajpur P.S. Case No. 19 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, I, Samastipur, or successor Court.
