2. The petitioner seeks bail in a case registered for the offence punishable under Sections-302, 201, 120(B) of the Indian Penal Code.

3. The bail of the petitioner was rejected vide order dated 14.03.2023 in Cr. Misc. No. 58049 of 2022.

4. Learned counsel for the petitioner has submitted that the petitioner has filed the application as the trial is not going on with snail pace whereas the petitioner is under custody since 05.05.2022.

5. A report was called for from the learned court below about stage of the trial that has been required and is available with the record which shows that not a single

Patna High Court CR. MISC. No.65867 of 2023(8) dt.22-11-2024 2/2 prosecution witness has been examined up-till-now whereas there are 8 witnesses are citing in the chargesheet. The record is still pending at the stage of appearance.

6. Learned APP has opposed the prayer for bail.

7. The learned court below is directed to immediately split up the case of the petitioner and shall take every endeavour to dispose of the trial within a period of nine months, failing which the petitioner shall be entitled for renewal of his prayer for bail.

8. With the aforesaid directions, this petition is disposed of.
