JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-05-2017 The petitioner seeks regular bail in connection with Special (NDPS) Case No. 04 of 2016, registered for offences punishable under section 22(b) of the NDPS Act. The allegation against the petitioner and other coaccused is of recovery of 92 kg. Ganja from the car in which the petitioner alongwith other accused were found sitting. It has been submitted on behalf of the petitioner that she is a co-passenger of the car and nothing has been recovered from her possession. She is a lady and has remained in custody for about six months.

The learned APP opposes the prayer for bail.

No.21589 of 2017 (3) dt.12-05-2017 2/2 Having heard both sides and in view of recovery of huge quantity of Ganja form the vehicle, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the trial court is directed to expedite the trial of the petitioner who is a lady and conclude the same within one year, if not concluded, the petitioner will be at liberty to renew her prayer for bail before the court below and the court below will pass appropriate order without being prejudiced by the order of this court on the basis of material available on record.
