2. The petitioner has preferred this application for grant of regular bail in connection with Chhauradano P.S. Case No. 264/2024 dated 26.10.2024 registered for the offences punishable u/s 49, 109, 118(2), 61(2) and 352 of the B.N.S. and Section 27 of the Arms Act.
3. As per the prosecution case, 7-8 miscreants came on bike and on the order of the co-accused, Ram Babu Mahto, the co-accused, Monu Kumar fired upon the informant due to which he received gun shot injury. Thereafter, nearby villagers came and he was taken to hospital for treatment.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.59748 of 2025(3) dt.10-09-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The specific allegation of firing is against the co-accused, Monu Kumar. The other co-accused person has been granted anticipatory bail by the co-ordinate bench of this court vide order dated 14.05.2025 passed in Criminal Miscellaneous No. 30620 of 2025. The petitioner has 18 antecedents and he is on bail in all the aforesaid cases as stated in para 3 of the bail petition. The petitioner is in custody since 27.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Raxaul, Motihari, East Champaran in connection with Chhauradano P.S. Case No. 264/2024, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable
Patna High Court CR. MISC. No.59748 of 2025(3) dt.10-09-2025 3/3 cause, the bail bonds of the petitioner is liable to be cancelled.
