The petitioners apprehend their arrest in connection with Siwan Mufassil P.S. Case No. 172 of 2015 registered under Sections 341, 323, 386, 307, 504, 506 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is that on 16.02.2015 in course of raising the boundary by the informant of his plot covering area of 2 Katha in Mohalla Bindusar, petitioners reached there and made demand of ransom Rs. 10,000,00/- saying that unless the ransom amount is not paid no one can sell or purchase the land here. When the informant made protest then the petitioners assaulted the
Patna High Court Cr.Misc. No.47164 of 2015 (3) dt.27-01-2016 informant by pressing his neck and also snatched Rs. 25,000/- from the pocket of the informant.
Learned counsel for the petitioners submits the informant tried to erect the boundary wall on the road then the petitioners made protest due to that reason only to give undue pressure informant lodged the Complaint Case No. 378 of 2015 against the petitioner which is the basis of the present case. Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Siwan, in connection with Siwan Mufassil P.S. Case No. 172 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
