This application for anticipatory bail arises out of Khagaria (Chitragupt Nagar) P.S. Case No. 66 of 2019 for the offence punishable under Sections 147, 148, 149, 114, 116, 117, 341, 342, 323, 352, 353, 337, 338, 355, 307, 504, 506, 509 and 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners has drawn my attention to an order of this Court dated 19.04.2019 passed in Cr. Misc. No. 24310 of 2019 (Annexure-2), whereby other co-accused persons have been allowed anticipatory bail.

No.56371 of 2019(2) dt.05-09-2019 2/2 On perusal of the First Information Report, I do not find any such distinguishing feature in accusation against the petitioners, which would have made me take a different view than what has been taken by this Court in the said order dated 19.04.2019.

Since the other accused persons have been allowed anticipatory bail, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Khagaria, in Khagaria (Chitragupt Nagar) P.S. Case No. 66 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
