JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2017 Heard learned counsel for the petitioner and the State. Today, a supplementary affidavit has been filed by the petitioner. Let it be kept on record.

In para-1 there was omission and sections 25(1-b) and 26/354 of the Indian Penal Code was mentioned in stead of section 399/402 of the Indian Penal Code and section 25(1b)a/26/35 of the Arms Act. The supplementary affidavit was filed for correction of the aforesaid mistake.

The petitioner is in custody since 9.1.2017 in connection with Kishanganj P.S. Case No. 5 of 2017 for the offence under section 399/402 of the Indian Penal Code and section 25(1-b)a/26/35 of the Arms Act.

Patna High Court Cr.Misc. No.21987 of 2017 (3) dt.06-06-2017 2/2 Learned counsel for the petitioner submits that similarly circumstanced Chand Mohammed @ Chan Mo @ Md. Chand was granted bail in Cr. Misc. No. 23439 of 2017 vide order dated 24.5.2017 by a Bench of this Court.

In view of the facts and circumstances stated above and the fact that the petitioner has no criminal antecedent as per statement made in para-3 of the bail application, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 15 of 2017 (corresponding to G.R. No. 42 of 2017) on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses. (Anil Kumar Upadhyay, J) Ravi/- U T
