For the Opposite Party/s : Mr. Madhura Nand Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P for the State.

The petitioners want to renew their prayer for bail which was earlier rejected by order dated 23.06.2010 passes in Cr. Misc. No. 12938 of 2016, on the ground that the petitioner are in custody since 28.10.2015, there was direction to conclude the trial within nine months but the trial has not been concluded and the petitioners were given liberty to renew their prayer for bail. The learned A.P.P. fairly submits that the trial has not been concluded.

In the facts and circumstances as stated above, the

No.22140 of 2017 (2) dt.25-05-2017 2/2 petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Banka in Sessions Trial No. 279 of 2016 arising out of Shambhuganj P.S. Case No. 69 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
