This application for anticipatory bail arises out of Benipatti P.S. Case N0. 186 of 2019, disclosing offences under Sections 341,323,354,353/34 of the Indian Penal Code.

The petitioner was an applicant for appointment as Anganwadi Sevika. The informant, at the relevant point of time, was posted as Lady Supervisor in Child Development Project Office, Benipatti. Allegedly on the date of occurrence, result of selection was announced. Aggrieved by selection of another applicant, allegedly, the family members of the petitioner suddenly attacked the informant and assaulted her.

Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, has

Patna High Court CR. MISC. No.56385 of 2019(2) dt.05-09-2019 2/2 submitted that there is no allegation against the petitioner of any nature. On perusal of the F.I.R, I find substance in the submission made on behalf of the petitioner.

This application is allowed.

Let the petitioner above named in the event of her arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipatti in Benipatti P. S. Case No. 186 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
