Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

According to prosecution case, on 01.01.2022 at 7.00 P.M. the petitioner along with other accused persons fired upon the husband of the informant and killed him.

Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation in the F.I.R. that the petitioner has fired upon the chest of the victim and he died on the spot. Thereafter the coaccused persons also fired upon the victim.

No.59405 of 2022(3) dt.16-02-2023 2/2 The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner on the basis of the materials available on the record as well as in the case diary and postmortem report and submits that the postmortem report confirms the allegation as levelled in the F.I.R. against the petitioner.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with S.T. No.101/2022, arising out of Kotwali P.S. Case No. 2/2022 pending in the court of learned Additional Sessions Judge-I, Munger.

Prayer is refused.
