Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code.

The petitioner is the mother-in-law of the victim Nilam Kumari who was married in the family of the petitioner in the year 2000. Suspicion is that the petitioner and others committed murder of Nilam Kumari as she was being tortured for different reasons.

Learned counsel for the petitioner submits that besides suspicion, there is no other material against the petitioner. Whereas learned counsel for the informant submits that a strong circumstantial evidence is there against the

Considering the fact that only material against the petitioner is suspicion and the petitioner is a female, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge-1st, Muzaffarpur/successor Court in connection with Kazimohammadpur Police Station Case No. 45 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
