2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118(2), 109, 352, 351(2), 3(5) & 103(1) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, in brief, is that on the alleged date and time of occurrence, 15 F.I.R. named accused persons including these petitioners and 4 - 5 unknown persons assaulted uncle of the informant, namely, Ajay Bind, by means of lathi, sword and knife, as a result of which, he fell down. It is further

Patna High Court CR. MISC. No.59409 of 2025(2) dt.03-09-2025 2/3 alleged that when the informant and others came to save him (uncle of informant), they were also assaulted by the accused persons. The uncle of the informant died during course of treatment.

4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. There is general and omnibus allegation and no specific overt act has been alleged against these petitioners. He further submits that from perusal of post-mortem report, the uncle of informant died due to shock, as a result of head injury. Case and counter case. Some of the similarly situated co-accused persons have already granted bail by this Court. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Ara, Bhojpur in connection with Sahpur P.S. Case No. 63 of 2025, subject to condition as
