JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 47/50 of the Bihar Excise (Amendment) Act, 2016.
About 210 liters of country made liquor was recovered near the bank of Sone river from where petitioner and others fled away in presence of the raiding party. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner and the petitioner was not caught at the spot. He is in custody since 27.01.2017.
Considering the aforesaid facts as well as the period
Patna High Court Cr.Misc. No.22689 of 2017 (2) dt.19-05-2017 of incarceration, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur (Patna) in connection with Bihta P.S. Case No.520 of 2016.
