JUSTICE SHAILENDRA SINGH ORAL ORDER 19-09-2025 Heard Mr. Bipin Bihari Singh, learned counsel for the Petitioner, Mr. Arvind Kumar, learned Special P.P. for the Vigilance Department and Mr. Ajay Mishra, learned APP for the State.
2. The petitioner apprehends his arrest in connection with Nalanda P.S. Case No. 121 of 2024 dated 31.07.2024 registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. As per the prosecution's case, this petitioner got appointment on the post of Panchayat Teacher on the basis of forged and fabricated educational certificates.
4. The main submissions advanced by petitioner's
Patna High Court CR. MISC. No.65819 of 2025(2) dt.19-09-2025 2/3 counsel are that this is the second attempt of the petitioner to get the relief of anticipatory bail and his first prayer was rejected by this Bench vide order dated 05.02.2025 passed in Cr. Misc. No. 1968 of 2025 and the fresh grounds for renewing the prayer are the relief of anticipatory bail granted to the several co-accused persons by the learned co-ordinate Benches of this Court vide orders passed in Cr. Misc. Nos. 6391/2025, 994/2025, 89893/2024, 78752/2024, 78441/2024 and the said co-accused persons are carrying the similar nature of allegation. It is further submitted that the petitioner was employed in the year 2013 and he himself resigned from his service on 08.09.2020 and presently he is not in the service.
5. Learned APP for the State has opposed the prayer for bail of the petitioner and submits that petitioner's earlier prayer has already been rejected on merit and the aforesaid grounds taken by the petitioner are not tenable for considering the petitioner's prayer again.

Considering the aforesaid submissions, this Court is not persuaded to take a different approach from that of taken earlier in view of the seriousness of the allegation which relates to huge monetary loss to the state exchequer on account of petitioner's employment in government service on the post of
Patna High Court CR. MISC. No.65819 of 2025(2) dt.19-09-2025 3/3 teacher on the basis of the alleged fake mark-sheet. Accordingly, petitioner's present prayer also stands rejected.
7. Petitioner is given a liberty to surrender before the trial court. If he avails this liberty in the next three weeks then the trial court will decide his regular bail prayer without being prejudiced with this order according to merit. (Shailendra Singh, J) maynaz/- U T
