The petitioner apprehends his arrest in Dhansoi P.S. case No.114 of 2016 under Section 406, 409, 420 of the Indian Penal Code.
The present case is lodged against the petitioner for not submitting folders of merit list with regard to appointment of Panchayat Teachers of Dulpha Panchayat.
The learned counsel for the petitioner submits that petitioner, Panchayat Secretary of Dulpha Panchayat, filed a petition on 06.09.2016 before the Block Education Officer stating therein that folders and file of Panchayat with regard to appointment of Panchayat Teachers for the year 2003, 2005, 2006, 2008 and 2012 have already been submitted on 03.08.2016. The petitioner again filed the records of appointment of Panchayat
Patna High Court Cr.Misc. No.45927 of 2016 (2) dt.25-11-2016 2/2 Teachers in M. V. High School, Buxar and records of 2008 was submitted in the office of Programme Officer, Buxar on 06.09.2016 even then the case has been lodged. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Dhansoi P.S. Case No. 114 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
