Petitioner apprehends his arrest in connection with Dehri Excise Case No.46 of 2016 for the offence registered under section 47(A) of the Bihar Excise (Amendment) Act, 2016. According to the prosecution case itself, the alleged recovery was made form the back side of the house of the petitioner. It is admitted case of the prosecution that nothing was recovered from the house of the petitioner. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the

Patna High Court Cr.Misc. No.44861 of 2016 (2) dt.06-12-2016 2/2 event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Rohtas at Dehri in Dehri Excise Case no. 46 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
