2. Petitioner seeks regular bail in connection with Hasan Bazar P. S. Case No. 38 of 2025 in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.
3. Informant suspects that this petitioner along with other accused persons committed murder of the grand mother of informant due to land dispute.
4. Learned counsel for the petitioner submits that informant is not an eye witness of the alleged occurrence and only suspicion has been raised against the petitioner. During
Patna High Court CR. MISC. No.60239 of 2025(3) dt.07-11-2025 2/2 investigation, none of the witnesses have claimed to have seen this petitioner committing the alleged offence. Petitioner claims clean antecedent and is in custody since 25.05.2025. Chargesheet has already been submitted.
5. However, learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Hasan Bazar P.
