JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2017 Heard learned counsel for the petitioner and the State. The petitioner was apprehended in connection with Ghora Sahan P.S. Case No. 30 of 2017 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the FIR that 30 bottles of Nepali wine was seized from the bag of the petitioner.

The petitioner is in custody since 30th January, 2017. In para-3 of the bail petition the petitioner has stated that he has neither bad antecedent nor any criminal history. In view of the statements made in para-3 of the petition and the fact that the petitioner is in jail since 30th of January, 2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM,

Patna High Court Cr.Misc. No.22072 of 2017 (3) dt.06-06-2017 2/2 Sikrahna at Dhaka, District East Champaran or the successor Court in connection with Ghora Sahan P.S. Case No. 30 of 2017, subject to the condition that the petitioner will extend full cooperation in the case and will not, in any manner, influence the witnesses.
