JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 20(b)(c) of the N.D.P.S. Act. Hundred grams of ganja was allegedly recovered from the possession of this petitioner when the petitioner had gone to supply the same to the prisoner.

Submission is that the recovered quantity comes within small quantity and he has got no criminal antecedent. Petitioner is in custody since 25.03.2017.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.22013 of 2017 (3) dt.20-06-2017 2/2 amount each to the satisfaction of learned Sessions Judge, Bhojpur at Ara/Successor Court, in connection with N.D.P.S. Case No.10 of 2017, arising out of Town P.S. Case No.160 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
