2. Petitioner apprehends arrest in a case registered for the offence punishable under section 126 ( 2 ), 115 ( 2 ), 329 ( 4 ), 118 ( 2 ), 76, 303 ( 2 ), 352, 351 ( 2 ) and 3 (5) of BNS.

3. As per the prosecution case, informant namely Praduman singh, allged that on 14.02.2025 at about 6 PM, this petitioner caught hold of daughter of informant from behind and was touching her inappropriately . When informant tried to rescue his daughter, this petitioner disrobed her daughter. It is further alleged that after the occurrence , all the F.I.R. named accused persons including this petitioner armed with pistols, iron rod assaulted informant and other family members.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . F.I.R,. has been lodged after the delay of 8 days for which there is no plausible explanation which itself crates doubt over the entire prosecution case . Case and counter case . The brother of petitioner has also lodged a case in Shahkund PS Case No. 31 of 2025 against informant and others.

Learned counsel for the State as well as informant opposed the prayer for bail and submitted that there is specific allegation against this petitioner that he was holding the daughter of informant and touching her inappropriately and when informant went to make complaint, this petitioner along with other co -accused persons assaulted informant and others.

6. Considering seriousness and the nature of accusation against this petitioner, gravity of of offence and other circumstances of the case , prayer for pre-arrest bail of the petitioner is rejected.
