JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 272, 273 of the I.P.C. and 30(A) of the Bihar Excise Amendment Act, 2016.

Allegation is that 1865 liters of foreign liquor was recovered from the truck.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.2.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 1865 liters of foreign liquor is said to have been recovered from the truck. The petitioner has got no concern with the seized article nor he has concern with the truck in question. He is simply a labourer. There is no compliance of Section 100 Cr.P.C. Other co-accused

Patna High Court Cr.Misc. No.23273 of 2017 (2) dt.23-05-2017 2/2 has been granted bail vide Cr.Misc.No.14761 of 2017. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. case No.87 of 2017.
