2. The petitioner seeks bail in connection with Chapra Mufassil P.S. Case No. 156 of 2024 registered for the offence punishable under Section 366(A) of the Indian Penal Code.
3. Para-11 of the bail petition reads as follows: "That in view of the discussions made above, it is evident that the victim granddaughter of the informant is having love affairs with the petitioner and subsequently she got performed marriage with the petitioner whereas on the date of alleged occurrence though she has been found to be a minor girl on the basis of her education certificate but on the date of occurrence she is approaching her age of majority as on the said date her age has been found as 17 years 07 months and 16 days, hence the present bail application of the petitioner may sympathetically be considered."
4. In view of the above, this application is disposed of
Patna High Court CR. MISC. No.67288 of 2024(2) dt.03-10-2024 2/2 with a direction to the trial Court to verify the fact as to whether the victim has got married to the petitioner or not. If the victim supports the fact of marriage then the petitioner shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Chapra Mufassil P.S. Case No. 156 of 2024.
5. If the victim says that she has not married to the petitioner, then the petitioner shall be released on bail. (Sandeep Kumar, J) P. Kumar U T
