The petitioner seeks bail in connection with Akbarnagar P.S. Case No. 73 of 2014 registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, the petitioner opened fire indiscriminately which hit the son of the informant in his head, resulting, he died at the spot and the informant any how succeeded in saving himself. Submission is of false implication and that the prosecution story appears not reliable and probable, due to land dispute the petitioner has been implicated, Title Suit is also going on and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of bail by submitting

Patna High Court Cr.Misc. No.22327 of 2017 (4) dt.04-07-2017 that the petitioner is the assailant.

In the facts and circumstances stated above, considering that the petitioner is the assailant, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
