The petitioner seeks bail in Pakaridayal P.S. Case No. 147 of 2016 registered under Section 384 and other sections of the Indian Penal Code.
The informant alleged that while he was returning after patrolling, he found many trucks standing on the road and four persons were collecting money from the driver of the trucks. On chase, Lalbabu Giri and Punyadev Mahto were apprehended. Lalbabu Giri and Punyadev Mahto disclosed the name of Shankar Paswan and Vishwanath Paswan who managed to flee away. It is further alleged that the apprehended persons disclosed that they used to collect extortion money from the drivers of the truck on

Leanred counsel for the petitioner submits that Punyadev Mahto and Lalbabu Giri were apprehended on the spot while they were collecting extortion money from the driver of the truck. Punyadev Mahto has been granted bail vide order dated 22.03.2017 passed in Cr. Misc. No. 12179 of 2017. Considering the facts aforesaid and the fact that the apprehended persons disclosed that they used to collect extortion money on behalf of the petitioner and others, but the petitioner was not apprehended on the spot, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 147 of 2016.
