2. The present application has been filed seeking recall of the order dated 27.09.2022 passed in CWJC No. 2309 of 2021 by which the writ petition was dismissed for want of prosecution.

3. Learned counsel for the petitioner submitted that he was assisting another Court when the matter was taken up and thus due to him not being able to reach in time, the writ petition stood dismissed. It was submitted that the petitioner has good case and shall suffer irreparable loss if the order is not recalled. Further, it was submitted that there is no deliberate laches on the part of the petitioner.

4. Learned counsel for the respondents oppose the prayer.

5. Having considered the submissions of learned counsel for the parties and upon going through the averments made in the application, the order dated 27.09.2022 passed in CWJC No. 2309 of 2021, stands recalled and the writ petition is restored to its original file and number.

6. The application stands disposed of.

7. This order is subject to removal of the defects by 13th December, 2022, by learned counsel for the petitioner, failing which the order shall stand recalled and the application shall be deemed to have been dismissed.
