2. The petitioner is apprehending his arrest in connection with Garkha P.S. Case No. 545 of 2022 in a case registered for the offence punishable under Sections 399, 402, 412, 413 and 414 of the Indian Penal Code and Sections 25(1b)a, 26 and 35 of the Arms Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the

Patna High Court CR. MISC. No.62503 of 2023(3) dt.13-10-2023 2/2 learned court below on the same day without being prejudiced by this order.
