JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner learned counsel for the informant as well as the learned A.P.P. The petitioner seeks bail in Taraiya P.S. Case No. 112/2017, registered for the offences punishable under Sections 363, 366, 366A, 34 of the Indian Penal Code.

The informant alleged that at about 8.00 P.M. on 04.04.2017 his minor daughter went to attend the call of nature, but the petitioner Basu Ram, Bablu Ram, Pankaj Ram, Raj Kumar Ram, Motilal Ram Kidnapped his daughter. It is further alleged that when he went to complain about the occurrence Madeshwar Ram, Chhatiya Devi, Tarkeshwar Ram and Chhotu Ram abused him.

Patna High Court Cr.Misc. No.22277 of 2017 (3) dt.23-06-2017 Learned counsel for the petitioner submits that occurrence took place on 04.04.2017, but the victim girl returned on 08.04.2017 along with the petitioner. The victim is a major girl. The victim in her statement recorded under Section 164 Cr.P.C. disclosed that the petitioner and one Raj Kumar Ram kidnapped her, although father of the victim narrated different story of kidnapping of her daughter. The doctor assessed the age of the victim to be 19 years. The victim did not complain any illtreatment or sexual assault against the petitioner. Considering the facts aforesaid and the fact that the petitioner is in jail for more than two and half months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Saran at Chapra in connection with Taraiya P.S. Case No. 112/2017.
