JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 This is an application for grant of bail for offences punishable under Sections 189, 203, 209, 327, 353, 387 and 506 of the Indian Penal Code.

Allegation against the petitioner is of impersonation of the then Hon'ble Judge of the Patna High Court. During the course of investigation it appears that the SIM is in the name of one Supriya Jha, who is an official witness, and in his statement recorded under Section 164 of the Code of Criminal Procedure he has named this petitioner stating the entire allegation against the petitioner.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he has remained in

Patna High Court Cr.Misc. No.22496 of 2017 (2) dt.11-05-2017 2/2 custody for about five months. It has further been submitted that earlier he was in custody in other case.

Heard learned A.P.P. also.

Having heard both sides and in view of the allegation made, I am not inclined to grant bail to the petitioner. However, considering the seriousness of the occurrence, learned trial court at Madhubani is directed to expedite the trial in connection with Madhubani Town P.S. Case no. 137 of 2015 of the petitioner and conduct the same on day to day basis so that it may be concluded within a period of six months. Superintendent of Police, Madhubani, is also directed to ensure attendance of the witnesses in the case.
