JUSTICE SANJAY PRIYA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioners and the State. The petitioner seeks bail in Complaint Case No. C2/139 of 2017 instituted for the offence under Section-30(a) of the Bihar Excise Amendment Act, 2016.

It is submitted on behalf of petitioner that petitioner is in custody since 06-03-2017. In paragraph-3 of the petition, it is mentioned that petitioner has clean antecedent. It is alleged that 100.500 litres of Nepali Saufi wine was recovered from possession of the petitioner. Keeping in view clean antecedent of the petitioner as well as the period, spent by the petitioner in jail custody, prayer for bail is allowed. The petitioner, named above is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties

Patna High Court Cr.Misc. No.24077 of 2017 (3) dt.18-07-2017 of the like amount each in connection with Complaint Case No. C2/139 of 2017 to the satisfaction of learned Chief Judicial Magistrate,, Sitamarhi subject to condition that both the bailors should be close relatives of the petitioner.
