====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Kahalgaon P. S. Case No. 82 of 2025 in a case registered for the offences punishable under Sections 103, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., on 12.03.2025 at about 10 PM, coaccused Nitesh Kumar took the husband of informant along with him but he did not return. Next day, dead body of the husband of informant was found in the wheat field with Gamcha tied around his neck. Informant suspects that coaccused Nitesh Kumar along with some unknown miscreants killed her husband.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.62460 of 2025(3) dt.10-11-2025 2/2 petitioner is not named in the F.I.R. and his name surfaced in this case on the basis of suspicion and self confessional statement. Petitioner is in custody since 15.03.2025. Chargesheet has already been submitted.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P. S. Case No. 82 of 2025.
